1. Acceptance of Terms
The services provided by this site (killietrust.org & killietrust.com) are subject to the following Terms of Use (TOU). We reserve the right to update the TOU at any time without providing you with prior notice. The most current version of the TOU can be viewed by clicking on the "Terms of Use" link located on the right hand column of each page. The section titles in the TOU are for convenience only and have no legal or contractual effect.
2. Killie Trust Memebership Application Form
This site enables its users join the Kilmarnock Supporters'
Society Ltd. by providing an application form which can be downloaded, printed, filled out and sent to the Trust along with the appropriate payment. By submitting this form to the Trust, you agree to provide true, accurate, current and complete information about yourself as prompted by the application form. You also agree
that this site and the Killie Trust assume no responsibility for the loss of, mis-delivery
or failed-delivery of the form, and that you assume responsibility for the cost
of paper, envelopes, postage and membership fee.
3. Trust Merchandise
This site allows its users to order official Killie Trust merchandise. By submitting an order form for any item, you agree to provide true, accurate, current and complete information about yourself as prompted by the application form and to provide a payment of for the specified amount by cheque payable to "The Kilmarnock Supporters' Society Ltd.". You also agree that this site and the Killie Trust assume no responsibility for the loss of, mis-delivery or failed-delivery of the form, and that you assume responsibility for the cost of paper, envelopes, postage and payment. Furthermore this site and the Killie Trust assume no responsibility for the mis-delivery or failed-delivery of the merchandise to you, or for any injury incurred by you or any other due to the misuse of a Killie Trust pin badge.
4. Members' E-mail
This site provides members of The Killie Trust with the opportunity to buy e-mail addresses priced at £5 each per year. By submitting the registration form for this service, you agree to provide true, accurate, current and complete information about yourself as prompted by the application form, to choose a suitable username and to provide a payment of £5 by cheque payable to "The Kilmarnock Supporters' Society Ltd.". You also agree that this site and the Killie Trust assume no responsibility for the loss of, mis-delivery or failed-delivery of the form, and that you assume responsibility for the cost of paper, envelopes, postage and payment.
After purchasing a killietrust.com e-mail address, you are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify the Webmaster immediately of any unauthorised use of your account or any other breach of security. This site and the Killie Trust will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by The Killie Trust or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.
As a condition of your use of a killietrust.com e-mail address, you will not use the service for any purpose that is unlawful or prohibited by the TOU. You may not use the service in any manner that could damage, disable, overburden, or impair the web server or interfere with any other party's use and enjoyment the service. You may not attempt to gain unauthorised access to e-mail accounts, computer systems or servers connected to the service, through hacking, password mining or any other means. You may not change the value in the "From" field of any outgoing e-mails. You may not obtain, attempt to obtain, submit or attempt to submit any materials or information through any means not intentionally made available through the service.
This site and the Killie Trust will not be held responsible for any of the content in e-mails or in pages linked to from e-mails sent to killietrust.com e-mail addresses.
This site and the Killie Trust reserve the right to terminate your access to the Members' E-mail service at any time, without notice, for any reason whatsoever.
5. E-mail Forms
This site provides its users with the facility to send e-mail to the
webmaster and the Killie Trust by the completion of an online form. It also
provides an "E-mail to Friend" service where users can send links to news items and features to other people. By using these services you agree to provide a true, accurate, current and complete information about yourself as prompted by the form(s).
6. Guestbook
This site invites its users to "sign" the
guestbook and leave any comments that they may have
about the website. On signing the guestbook, you understand and agree that the
name and e-mail address you provide are true, accurate, current and belong to
yourself. You also agree that if you chose to make your e-mail address "public",
this site and the Killie Trust assume no responsibility for its misuse by other users of the site.
